Appointing a Property Receiver for a Property

Financial institutions normally appoint fixed charge receivers. A lender with a mortgage can also appoint these professionals. Appointing these professionals is fairly inexpensive. The procedure can also be handled quickly.

Usually, the receiver obtains some broad powers. These powers are explained in the mortgage deed. However, the appointment of the professionals depends on the responsibilities that the individual is required to handle.


Functions of the Receiver

These professionals are known under many different names. Some refer to them as LPA or Law of Property Act Receiver as well. The property receiver has several responsibilities.

Asset stabilisation is one of the main tasks that these professionals are expected to perform. In addition, they determine the suitable strategies that may help in the asset stabilisation process.

Only property experts with in-depth knowledge of real estate law can work as a receiver. The primary duty of the professionals is towards the lender or the entity who has appointed them.

However, in some cases, they may have some sort of duty towards the borrowers and guarantors also. The receiver is required to act in good faith towards all the parties concerned.

Actively managing the asset is another job requirement of the professionals. Sometimes, they handle the rent reviews and collect rent as well. Due to the requirement of the job, the responsibilities may include the sale of the properties to repay loans.

Power of the Receiver

The powers these professionals enjoy are limited. According to the property law, they have got the power to sell a property. They can also collect rent. When they wish to handle a business, particular care needs to be taken. The power may differ depending on the cases.

Sale of the Asset

Once the sale terms are accepted, the receivers complete the task. However, they do not have the power to answer any question formally. In this case, the buyer should be satisfied that the receiver has been properly appointed.    

Need for Insolvency Expert

Sometimes, appointing a receiver is not an appropriate action. When the property management involves running a business, expertise of these professionals will not be appropriate.

For properties like hotels and restaurants, appointing insolvency experts will be a good idea. Managing this type of property and dealing with the staff members require specific training. The fixed charge receiver may not have the required skills and expertise in these areas.

Cost Effectiveness of Fixed Receivers

The cost may vary depending on the requirement of the cases. However, even so, appointing a fixed charge receiver is more cost effective than any alternatives. However, it is advisable to check out the charges before appointing anyone.

Finding the Right Receiver

You will find several estate management agencies that deal with property receivership. That is why it may seem like a difficult task to find the right one for your requirement.

The real estate agency needs to be an established one to handle this task. Explore different resources to find the contact details of different real estate companies. Make sure to meet the representatives of the shortlisted companies. Enquire about the areas of specialisation before making a final decision.

Appointing the Receiver

The duties and responsibilities of the receiver are included in the mortgage deeds. To hire the professional, lenders or the financial institutions need to create legal documents.

These documents contain details related to the power of the professionals. Terms and conditions of the agreement are explained in these documents as well. In case the terms and conditions are breached, the receivership can be terminated.  

Removal of Receivership

The appointer can remove or replace the receivership any time. The professionals may even resign. However, before the removal, the appointer needs to pay the receiver full fee. The fixed charge receiver can be removed by a court order.
